Una de las grandes asignaturas pendientes de este país en cuanto a la protección del menor en las carreteras nacionales es la que engloban los transportes escolares, excursiones y uso del menor en transporte público. En este post vamos a hablar, concretamente, del autobús escolar.
¿Es seguro para los niños viajar en el autobús escolar?
La lucha de las familias y personas volcadas en mejorar esta situación cada vez es más frecuente afortunadamente, pero aún así nos encontramos con altos muros sostenidos por la famosa frase “cumple la normativa” que son muy difíciles de superar.
Cada vez que alguna familia informada en la seguridad de los más pequeños se encuentra en la situación de firmar una autorización para que su peque use el transporte escolar, comienza la oleada de preguntas.
¿Va a ir seguro? ¿Hay algo que pueda hacer yo para mejorarlo? ¿Por qué el colegio lo permite? ¿Por qué el gobierno lo permite? ¿Puedo llevarle yo a las excursiones?
Hay diferentes formas de plantear un artículo como este, se puede hacer desde el enfado y la frustración y que sólo sirva para amargarte el café…. O se puede hacer desde la perspectiva de quienes ya lo han conseguido y nos han abierto una puerta. Desde la visión de alguien que sabe que con tesón y paciencia, con información y la ciencia de la mano, se dan grandes pasos hacia adelante. Nos quedamos con esta opción, ¿os parece?
Estoy en el consejo escolar de la escuela de mi hija y el año pasado pedí permiso para solicitar presupuestos a las diferentes empresas de autobuses de la zona. Sabía que iba tarde, pero descubrí muchas cosas que me parece importante señalar aquí para que tengas en cuenta si te atas la cincha a la cabeza como Rambo y te preparas para perseguir este cometido.
Lo primero que descubrí es que profesionales de la educación con un plan educativo alternativo y respetuoso, basado en el cuidado emocional de los más pequeños y volcadísimos en cuidarles como si de tesoros se trataran…. no estaban siendo conscientes ni en lo más mínimo de la peligrosidad a la que se veían expuestos los alumnos cada vez que se sentaban en esos autobuses.
“Cumplimos las normativas”. Lo sé. Pero es que la normativa no sirve para nada en este caso (lo veremos enseguida). Ojos abiertos como platos cuando les expliqué la situación y todas las facilidades del mundo para buscar una empresa más comprometida con la seguridad infantil.
Vale, primera barrera superada. Seguimos.
Medidas de seguridad en el autobús escolar
El siguiente paso fue ponerme en contacto con las diferentes empresas de autobuses y ninguna. Escucha bien: ¡Ninguna! tiene autobuses con cinturones de tres puntos en todas las plazas.
Primer muro.
Tuve conversaciones de todo tipo. Personas muy educadas que me escucharon y me argumentaron su posición, otras que se ofrecieron para buscar soluciones… y otras que se rieron en mi cara, me trataron como si fuera una ignorante y se protegen tirando los precios e incumpliendo normas establecidas para los conductores de autobuses (cuidado que esto es un punto a contemplar del que poco se habla y que es más que denunciable).
Aquí tenemos dos muros: el de las empresas a las que les da igual y el del equipamiento de los autobuses. No se pueden instalar cinturones de seguridad de cualquier manera, hay que cambiar el asiento, probablemente quitar filas…. y eso puede salir más caro que el propio vehículo. ¿Quién asume la inversión de la renovación de la flota de autobuses? A esta inversión hay que añadirle el coste de la compra de los alzadores.
Cuarto muro. Uno enorme. En el que menos pensamos: La oposición de las familias.
Que sí, que es sorprendente, pero que hay familias a las que les da igual o no pueden asumir mayores gastos y que frente a dos presupuestos para el transporte escolar de sus hijos e hijas, elegirán el más barato sin plantearse por qué es el más barato y sin mirar si se cumplen normas de conducción segura, las revisiones de los vehículos, etc.
Aquí es súper importante llegar a un punto de encuentro entre todas las personas implicadas y aportar la información necesaria desde la calma y en modo martillo pilón. Sigue, sin cansarte y sin salirte del tiesto… sigue, que al final te escucharán seguro. Todos los años entra gente nueva en los colegios y cada vez más son los que miran la seguridad.
¿Y dónde consigues esta información?
Me remango y al barro.
A día de hoy en todo el territorio nacional podéis encontrar tres plataformas serias que están trabajando duro de forma desinteresada para el bienestar y la seguridad de los escolares:
- Plataforma TES (Transporte Escolar Seguro). Nace como un apoyo a las familias y asociaciones de madres y padres en los colegios, aportando documentos, informes de todo tipo, argumentos, contacto de empresas de autobuses con cinturones de tres puntos, tiendas especializadas que también se encuentran al pie del cañón… y facilitando el camino para conseguir mejoras en el transporte escolar.
- Plataforma Cinco Puntos. Con una fortaleza impresionante y sabiendo que las cosas bien hechas llevan su tiempo, llegaron hasta el Parlamento Europeo y consiguieron que se contemplase una revisión y actualización de la normativa. Se dedican más a la lucha por el cambio legislativo y ofrecen charlas.
- STEC (Seguridad para el transporte escolar en Catalunya). Es una plataforma más joven, pero con una fuerza inmensa para conseguir el cambio. Hay que decir que en Cataluña es donde más avances positivos se han conseguido y hay varios colegios que ya no contemplan otra forma de viajar.
Es necesario el cambio en una normativa tan obsoleta y anticuada, en la que hay tantos vacíos legales que te puedes perder. Vamos a comentar ahora aquí la normativa para que veáis que no miento cuando digo que aquí se habla entre poco y nada de seguridad frente a un frenazo o impacto.
Además, como punto a poner con un luminoso rojo y sirenas de “cuidado, barbaridad al canto”, dice que los peques de 5 a 11 años podrán utilizar el cinturón de seguridad de tres puntos ubicado en los asientos que queden frente a los pozos de las escaleras y con un calzador.
Ahá. Muy bien. ¿Y los de tres años o los que vayan en cualquiera de los otros asientos? Pues esos con un cinturón de dos puntos y oye, que como están nuevecitos pues igual se rompen menos por la cadera o colisionando con el asiento de delante. Le pones un casco de bici de 15,99 euros del súper que también está homologado y santaspascuas.
Voy a haceros un resumen porque no tiene desperdicio:
Normativa niños en autobús
- El cinturón de seguridad es obligatorio en todos los vehículos de transporte de pasajeros matriculados desde finales del 2007. Y dirás “uy qué bien”… pues no. Porque estamos hablando de cinturones de dos puntos, algo que no te pones con tranquilidad como adulto ya que sabes que puede provocarte lesión… pero no nos importa que los peques se lo pongan.
- Tacógrafo, limitador de velocidad y ABS que cumplan con lo establecido en la normativa.
- Los viajes no pueden exceder de una hora, hay que hacer paradas en caso contrario.
- Si transportan alumnos o alumnas con necesidades especiales debe haber ayuda técnica como rampas y se reservarán las plazas delimitadas para ellos. Vale. ¿Y cómo van a ir sentados? ¿En un asiento recto como un palo con un cinturón de dos puntos o de tres puntos frente a uno de los pozos?
- Seguro, ITV y antigüedad máxima de 16 años.
- Suelo antideslizante, sistema homologado de extinción de fuego, botiquín de primeros auxilios, escalones debidamente señalizados y ventanas que no se abran, pero que permitan la ventilación abriéndose un poco por la parte de arriba.
- Cartelitos de transporte escolar visible así como los de las entradas y salidas.
- Un niño por plaza y con el cinturón puesto (el de dos puntos, recordemos, independientemente de que por su tamaño, edad y desarrollo necesiten un sistema de protección más exigente. Y digo de protección, no de sujeción).
- Tiene que haber un acompañante si la mitad de las plazas están ocupadas por menores de 12 años, pero ojo: este acompañante NUNCA debe viajar al lado del conductor sino que deberá ocupar plaza en las inmediaciones de la puerta de servicio central o trasera. Real Decreto 443/2001 del 27 de abril.
Y ya. Esto es todo amigos. Para las personas más incrédulas o escépticas (cuidado, que está muy bien cuestionarlo todo) que me digan “que hay pocos accidentes en los que se vean implicados los autobuses” os diré que tenéis razón en que la estadística dice que el número es menor. Pero en la campaña realizada por la DGT en diciembre de 2021 se ha sancionado a 4 de cada 10 vehículos por no cumplir algún punto de la ya mencionada normativa. Y esto, perdonadme, sube el número de papeletas para que pase algo.
Debido a estas carencias salen al mercado artilugios de sujeción basados en sistemas de retención infantil que evitan que los peques salgan volando, pero no os olvidéis de que el arnés de frente a la marcha es lesivo. Por tanto, sustituir el cinturón de seguridad de dos puntos por esto sería como darle a elegir al peque: «córtate con una sierra o tírate por la ventana. ¿Qué eliges?».
Vale, me he puesto seria. Vamos a compensarlo porque si no…
Os dejo por aquí diferentes colegios (y asociaciones de madres y padres de estos colegios) que han conseguido darles a esos peques lo que merecen en el transporte escolar: seguridad.

También hay empresas de autobuses muy comprometidas, como La Pamplonesa, que tratan de ayudar en lo que pueden.
Y si no conseguimos cambiar nada, ¿puedo llevar yo a mi peque a las excursiones?
Quiero terminar recordándote que estás en tu pleno derecho de llevar y traer a tu peque de las excursiones si así lo consideras y que si tienes ganas y fuerzas, este tema hay que llevarlo arriba, muy arriba. Y que cuanto más se oiga, más visible se hará y podremos cambiarlo.
Lo que siempre digo es que esto es una carrera de fondo. Tranqui, no te canses, sigue, no desistas. Si no es este año será al siguiente, pero te garantizo que se va a notar todo el esfuerzo invertido.
